Jason Klitenic
Jason Klitenic is a founding member of Klitenic Robertson PLLC and KR Security LLC. He represents clients in an array of government regulatory, enforcement and public policy matters, including corporate compliance initiatives and investigations. Mr. Klitenic is Vice Chair of the American Bar Association’s Committee on Homeland Security and National Defense.
From 2003-2005 Mr. Klitenic served as the Deputy General Counsel of the United States Department of Homeland Security (DHS), the agency's second-ranking legal officer. In this role, he was responsible for advising the Secretary and other senior leadership on legal issues arising throughout DHS, including those relating to immigration, customs enforcement, data privacy, environmental compliance, international agreements, CFIUS reviews, complex civil litigation, the SAFETY Act, transportation and cargo security, labor and employment, public health, incident management, procurement, grants, infrastructure protection, intelligence sharing and investigations. He was also responsible for overseeing the operations of the 1,500-lawyer Office of the General Counsel. In addition, Mr. Klitenic worked closely with his counterparts at the White House, Departments of Justice, State, Treasury, Defense, Health and Human Services, as well as other agencies, to coordinate counterterrorism, emergency response and federal law enforcement initiatives. In 2005 Mr. Klitenic was appointed DHS acting General Counsel and served as the chief legal officer of the 180,000-employee agency.
From 2002-2003 Mr. Klitenic served as Deputy Associate Attorney General of the United States Department of Justice. There he oversaw matters in the Antitrust Division, Civil Division, Civil Rights Division, Environment and Natural Resources Division and other DOJ components, including matters regarding Civil False Claims Act litigation, corporate fraud, bankruptcy, environmental enforcement, terrorism, healthcare fraud and immigration. While at the Justice Department, Mr. Klitenic also coordinated international trade policy, served as a member of the administration's Trade Policy Review Group and participated in the negotiations of the US-Singapore, US-Chile and US-Australia Free Trade Agreements.
In addition to his public service, Mr. Klitenic has been a partner at two national law firms and served as investigation counsel to the court-appointed Examiner in a major bankruptcy matter.
Mr. Klitenic received his J.D. from the University of Baltimore and B.A. from Johns Hopkins University, where he was an all-America baseball player. He is admitted to practice in Washington, D.C. and Georgia.
Mark J. Robertson
Mark J. Robertson is a founding member of Klitenic Robertson PLLC and KR Security LLC. He represents clients in an array of government regulatory, enforcement and public policy matters and counsels clients on transactions involving homeland security technology.
Mr. Robertson served with the U.S. Department of Homeland Security as the Associate General Counsel for the Science & Technology Directorate. He also served as Chief of Staff to the General Counsel where he managed legal operations and provided legal and policy guidance on issues arising throughout the department.
Mr. Robertson played a central role in the development of the final regulations implementing the Support Anti-terrorism by Fostering Effective Technologies Act of 2002 (SAFETY Act) and provided key support to the Department's programmatic efforts to improve implementation of this important homeland security legislation.
As the Associate General Counsel for Science & Technology, Mr. Robertson provided legal and policy advice concerning the Department's research and development efforts focused on countering chemical, biological, radiological and nuclear threats, as well as the dangers of infectious disease. In this capacity Mr. Robertson oversaw DHS contracting with the private sector, academia and the Department of Energy national laboratories as well as the activities of the Homeland Security Advanced Research Products Agency (HSARPA).
Mr. Robertson also provided guidance on issues relating to immigration, customs enforcement, data privacy, international agreements, CFIUS transactions, transportation and cargo security, bio-defense, public health, incident management, procurement, grants, infrastructure protection, intelligence sharing and investigations. In addition, Mr. Robertson worked closely with counterparts at the White House, Departments of Justice, Energy, State, Treasury, Defense, and Health and Human Services to coordinate counterterrorism, emergency response and federal law enforcement initiatives.
From 2003-2004 Mr. Robertson served as Senior Policy Advisor with the U.S. Department of Energy. At DOE, Mr. Robertson supported Department-wide efforts to implement the National Energy Policy recommendations and supported international energy policy initiatives, including those involving trade in Liquefied Natural Gas and alternative energy market development.
Prior to his public service, Mr. Robertson practiced with national law firms representing emerging, privately-held and public companies with general corporate, commercial transactions, mergers and acquisitions, and finance matters. Mr. Robertson received his J.D. from the University of Virginia School of Law and B.A. from Hampden-Sydney College in Virginia. He makes his home in Alexandria, Virginia with his wife, Kelley, and currently serves as the president of the Kiwanis Club of McLean, Virginia.
Mr. Robertson is admitted to practice in Washington, D.C., Virginia and New York.
